State Senator Files Challenge Toward Rules Established in LB 574
LINCOLN–(KFOR Sept. 26)–A Nebraska lawmaker has formally challenged rules set forth in LB 574, which includes abortion banned after 12 weeks gestation and does not allow gender-affirming surgical procedures for people under 19-years-old.
Omaha Senator Machaela Cavanaugh on Thursday filed the challenge toward rules and regulations established by the Nebraska Department of Health and Human Services, claiming they raise legal and constitutional concerns related to the Federal Civil Rights Act. Cavanaugh says they put unreasonable burdens on patients and health care providers.
In a statement, Cavanaugh said “the undue burdens placed on patients and healthcare providers far exceed the statutory language and intent of LB 574, leaving an impact on the well-being of transgender individuals and their families.
