LINCOLN–(KFOR Oct. 29)–Front and center in Lancaster County District Court on Tuesday is Nebraska’s two medical marijuana ballot measures.

John Kuehn, a former state senator from Heartwell and former State Board of Health member, filed the initial lawsuit Sept. 12 seeking to invalidate the petitions, arguing backers didn’t collect enough valid signatures for access on the Nov. 5 ballot.

The Nebraska Attorney General’s Office, is seeking to invalidate tens of thousands of signatures for alleged “malfeasance” by notaries or “fraud” by circulators, for about a dozen campaign volunteers.  No matter what happens in court, the measures are still on the ballot and a decision on the case might not be determined by Election Day on Nov. 5.
