Amended Complaints Toward Medical Marijuana Initiatives Overruled by Judge
LINCOLN–(KFOR Dec. 6)–Looks like another setback in the lawsuit against two medical marijuana ballot initiatives that were passed by a majority of Nebraska voters last month.
On Thursday, Lancaster County District Court Judge Susan Strong overruled a motion to amend the complaints from former Heartwell State Senator John Kuehn and Nebraska Secretary of State Bob Evnen. Judge Strong denied the latest requests from Kuehn and Evnen because even if considered and accepted, they would not have altered the outcome of the case.
Kuehn had initially had sued to stop the initiatives from being placed on the ballot, while Evnen filed a cross-claim against Nebraskans for Medical Marijuana. In last week’s decision, Judge Strong said Kuehn and Evnen’s legal teams were only able to prove that several hundred signatures should be deemed invalid, coming up short in determining if the two measures would be void.
